Privacy Policy
What this document covers. This policy explains how we handle personal information collected through this website, the item enquiry form, and the process of consigning an item for sale.
Navigate Japan Limited operates several Home & Heart service lines under the same overall privacy commitments. This policy is scoped specifically to Resale Consignment; our broader company-wide practices are set out in the Home & Heart Privacy Policy, which this policy sits alongside.
Who we are
This Privacy Policy is issued by Navigate Japan Limited, a company registered in New Zealand (NZBN 9429052367342), trading as Home & Heart Resale Consignment. In this policy, "we," "us," and "our" refer to Navigate Japan Limited.
We are committed to handling personal information in accordance with the Privacy Act 2020 and its Information Privacy Principles.
Information we collect
When you enquire about an item or consign one with us, we collect:
- Contact details — your first and last name, phone number, and email address.
- Item information — a description, category, and photographs of the item, and its location.
- Assessment and sale information — the assessed value, any reserve, the auction house or platform used, the sale price achieved, and the commission and fees charged by that auction house or platform.
- Identity information — see Section 3.
- Payment details — the bank account you nominate for your share of the proceeds.
- Anything else you choose to tell us in the enquiry form's free-text fields.
We do not knowingly collect more information than we need to assess and sell an item on your behalf.
Identity verification
Why we sight photo ID before consigning an item
As a licensed secondhand dealer, we're required by the Secondhand Dealers and Pawnbrokers Act 2004 to verify the identity of the person we acquire goods from. Before you sign a Consignment Authority, we sight photo ID (a NZ driver licence, NZ passport, or similar) and record your full name and address.
We do not normally keep a copy of the ID document itself or record its number — sighting it and recording your name and address is enough to meet our obligation. Where a copy is retained in a particular case, it's stored securely, used only for that purpose, and deleted on a schedule agreed and recorded at the time.
Where you're signing as an executor, administrator, attorney, or other authorised agent rather than the owner, we also record which authority you've shown us (such as a will, probate, letters of administration, or a solicitor's letter) to confirm you're entitled to deal with the item. This is separate from, and doesn't replace, the identity check above.
How we collect it
Most information is collected directly from you — through the enquiry form (processed via Formspree, a third-party form-handling service, before reaching us by email), and in person when we assess an item and complete a Consignment Authority.
Why we collect and use it
We collect and use this information to:
- respond to your enquiry and give you an honest first read on an item;
- assess and record an item's condition and value;
- list and sell the item through an appropriate auction house or platform, acting as your agent;
- meet our legal obligations, including record-keeping under the Secondhand Dealers and Pawnbrokers Act 2004; and
- pay your share of the proceeds and provide a settlement statement.
We do not use your personal information for marketing by a third party, and we do not sell personal information.
Who we may share it with
We may share personal information with:
- Formspree, the third-party service that processes enquiry form submissions on our behalf;
- the auction house or platform selling the item, to the extent needed to list and sell it — typically the item's description and photographs, and your details only where the sale itself requires it;
- government agencies where we're legally required to — for example, in connection with our secondhand dealer licence; and
- our professional advisers, such as our accountant, where relevant to a specific matter.
We do not share personal information with third parties for their own marketing purposes.
Storage and security
We take reasonable steps to protect personal information from loss, unauthorised access, use, modification, or disclosure. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.
How long we keep it
We keep personal information only as long as it's needed for the purpose it was collected for, or as required by law.
- Enquiries that don't proceed to a consignment — kept for a reasonable period in case you follow up, then deleted or anonymised.
- Consigned items and settlement records — kept for as long as required under the Secondhand Dealers and Pawnbrokers Act 2004, and for our own tax and accounting obligations.
- Identity verification records — kept as described in Section 3. Where no copy of your ID is retained, we keep only the sighted-and-confirmed record, for as long as the Act requires.
Cookies and website analytics
This website does not currently use tracking cookies, advertising pixels, or third-party analytics beyond the form-processing service described in Section 4. If that changes, we'll update this section to describe what's collected and how you can control it.
Access and correction
Under the Privacy Act 2020, you have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it's wrong. To make a request, contact us using the details in Section 14. We'll respond within the timeframes required by law, and will tell you if we're unable to provide access or make a correction, and why.
Children's privacy
Our services are directed at adults able to authorise the sale of an item. We do not knowingly collect personal information from children.
Complaints
If you have a concern about how we've handled your personal information, please contact us first using the details in Section 14 — most concerns can be resolved directly. If you're not satisfied with our response, you may complain to the Office of the Privacy Commissioner at privacy.org.nz.
Changes to this policy
We may update this policy from time to time, including to reflect changes to our services, this website, or the law. The version published here is the version in effect, taking effect from the date shown at the top of this page.
