What this document covers
This page governs your use of this website and the online booking form. It is not the contract for the maintenance work itself.
Property Maintenance is a service line of Home & Heart, operated by Navigate Japan Limited under Schedule B of the Home & Heart Terms & Conditions. Schedule B is the document that actually governs a maintenance job — scope, rates, deposits, cancellation, and what happens if something is damaged. Where anything on this website differs from Schedule B, Schedule B applies to the work itself.
Section 1
Who we are, and how this fits together
This website (and the booking form linked from it) is operated by Navigate Japan Limited (NZBN 9429052367342), trading as Home & Heart Property Maintenance — one of several Home & Heart service lines operated by the same company.
By using this website or submitting the booking form, you agree to this document. It applies alongside, and does not replace, the Home & Heart Terms & Conditions (in particular Schedule B, which governs Property Maintenance work specifically) and our Privacy Policy.
Section 2
This website is not an offer of services
Nothing on this website constitutes an offer capable of acceptance. Browsing this website or submitting the booking form does not, by itself, create a contract between you and us.
A contract for a specific maintenance job is formed once we've confirmed a booking with you and, for anything beyond a small job, once the scope is agreed in writing — normally on the job sheet you initial before work starts, as set out in Schedule B.
Section 3
Booking a visit
Submitting the booking form does not commit you to anything and does not commit us to a specific time until we've confirmed it. We aim to respond within 1 business day.
Information you provide when booking — the property, the work, your contact details — is used to prepare a quote and, if you go ahead, to carry out the work. See Section 9 for how we handle that information.
Section 4
Rates shown on this website
The rates below are the standard published rates for Property Maintenance. They're shown here for general guidance; the rates that actually apply to your job are the ones in Schedule B, current as at the date you book.

All rates exclude GST.
Section 5
What we don't do
Some work needs a licensed trade rather than a general maintenance visit. We don't carry out:
- electrical work beyond changing bulbs, fluorescent tubes, or starters;
- plumbing, gasfitting, or drainlaying;
- work affecting a building's primary structure or weathertightness, or anything requiring a building consent;
- asbestos work; or
- work at height beyond what a standard ladder safely allows.
If we find something requiring a licensed trade once we're on site, we'll tell you before doing anything about it, and can recommend someone appropriate.
Section 6
Related-party work
Where Property Maintenance carries out work at a property managed by Home & Heart Property Management, that's related-party work. It's charged at the same published rates, disclosed to the owner in writing before it's booked in regardless of value, and identified as related-party on the owner's monthly statement. An owner can direct at any time that only outside contractors be used at their property.

Where this website refers to licensing requirements for electrical, plumbing, gasfitting, or building work, that reflects our understanding of the relevant New Zealand licensing regimes at the time of writing. These are general statements, not legal advice about your specific situation.

Intellectual property
The text, design, and layout of this website, and the Home & Heart name and branding, are owned by or licensed to Navigate Japan Limited. You're welcome to browse and print it for your own non-commercial use while considering our services. You may not reproduce, republish, or distribute the content commercially without our prior written consent.
Section 9
Privacy
Personal information collected through this website and the booking form is handled in accordance with the Privacy Act 2020 and our published Privacy Policy, which explains what we collect, why, and how you can access or correct it.
Section 10
Liability and your consumer rights
To the extent the law allows, Navigate Japan Limited is not liable for loss arising from your use of this website or reliance on its general content. This is about the website; it doesn't limit or affect the liability terms in Schedule B, which apply to the actual work and are agreed separately.
Nothing in this document excludes, restricts, or modifies any right or remedy that can't lawfully be excluded, restricted, or modified — including under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Governing law
This document is governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from your use of this website.

Changes to this document
We may update this document from time to time, including to reflect changes to our services, this website, or the law. The version published here is the version in effect, taking effect from the date shown at the top of this page.
