What this document covers

This page governs your use of this website and the item enquiry form. It is not the agreement for consigning a specific item.

Resale Consignment is a service of Home & Heart, operated by Navigate Japan Limited under Section 7 of the Home & Heart Terms & Conditions — in particular clause 7.3 (how proceeds are shared), 7.5 (title to goods), and 7.7–7.9 (assessment, reserves, and unsold items). For a specific item, the actual agreement is the Consignment Authority you sign before the item leaves the property, which records the item, its assessed value, and your consent. Where anything here differs from Section 7 or a signed Consignment Authority, those documents apply to the item.

Who we are, and how this fits together

This website (and the enquiry form linked from it) is operated by Navigate Japan Limited (NZBN 9429052367342), trading as Home & Heart Resale Consignment — one of several Home & Heart service lines operated by the same company.

By using this website or submitting the enquiry form, you agree to this document. It applies alongside, and does not replace, the Home & Heart Terms & Conditions (in particular Section 7) and our Privacy Policy.

Section 2

This website is not an offer of services

Nothing on this website constitutes an offer capable of acceptance. Browsing this website or submitting the enquiry form does not, by itself, create a contract between you and us, and does not commit us to consigning any item.

A consignment arrangement for a specific item is formed only once you've signed a Consignment Authority for that item, before it leaves the property.

Section 3

Enquiring about an item

Submitting the enquiry form does not commit you to anything. We aim to respond within 1 business day with an honest first read on whether consignment or a clearance discount is likely to suit the item better.

A first read from a description or photo is not a formal assessment. A formal assessed value is only recorded once we can see the item and it's written on a Consignment Authority.

Section 4

How consignment works

Where you consign an item, you keep ownership of it until it sells. We act as your agent: we select the auction house or platform, handle collection, photography, listing, and buyer management, and sell it on your behalf.

Once it sells, you receive 50% of the Consignment Proceeds — the sale price less the auction house's or platform's own commission and fees, which are set by them and confirmed with you in writing before consigning — paid by bank transfer within 30 calendar days of us receiving cleared funds, with a written settlement statement for the item.

If it doesn't sell, you owe nothing.

Section 5

What qualifies

Each item must be individually assessed above $300 to be consigned. Below that, consignment isn't offered — where there's resale value in a smaller item, it's more likely to be reflected as a discount against a clearance fee instead.

Consignment or a clearance discount — not both, per item

These are two different arrangements, recorded on two different documents. An item is either consigned (you keep ownership, sell price shared 50/50) or taken as part of a clearance (ownership transfers to us, reflected as a discount on the clearance fee) — never both for the same item.

Section 6

The Consignment Authority

Before an item you've agreed to consign leaves the property, you'll sign a Consignment Authority. It records the item, its condition, its assessed value, any reserve, and your consent to us acting as your agent and keeping 50% of the Consignment Proceeds. You can change your mind about any item before it leaves the property, at no charge.

Section 7

Identity verification

As a licensed secondhand dealer, we're required by the Secondhand Dealers and Pawnbrokers Act 2004 to verify the identity of the person we acquire goods from. As part of signing a Consignment Authority, we'll sight photo ID and record your name and address. We don't normally keep a copy of the ID itself — see our Privacy Policy for how this is handled.

Regulatory references

Where this website refers to our secondhand dealer licence or identity-verification obligations, that reflects our understanding of the Secondhand Dealers and Pawnbrokers Act 2004 at the time of writing. These are general statements, not legal advice about your specific situation.

Section 9

Intellectual property

The text, design, and layout of this website, and the Home & Heart name and branding, are owned by or licensed to Navigate Japan Limited. You're welcome to browse and print it for your own non-commercial use while considering our services. You may not reproduce, republish, or distribute the content commercially without our prior written consent.

Section 10

Privacy

Personal information collected through this website and the enquiry form is handled in accordance with the Privacy Act 2020 and our published Privacy Policy, which explains what we collect, why, and how you can access or correct it.

Section 11

Liability and your consumer rights

To the extent the law allows, Navigate Japan Limited is not liable for loss arising from your use of this website or reliance on its general content, including an informal first read on an item's likely value. This is about the website; it doesn't limit or affect the terms in Section 7 or a signed Consignment Authority, which are agreed separately and apply to the actual consignment.

Nothing in this document excludes, restricts, or modifies any right or remedy that can't lawfully be excluded, restricted, or modified — including under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Section 12

Governing law

This document is governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from your use of this website.

Changes to this document

We may update this document from time to time, including to reflect changes to our services, this website, or the law. The version published here is the version in effect, taking effect from the date shown at the top of this page.
