Website Terms & Conditions

What this document is — and isn't. These terms govern your use of this website. They are not, and are not intended to be, a property management service agreement.

If Home & Heart Property Management manages your property, that relationship is governed by your individually signed Property Management Agreement — a separate document you receive and sign before any service begins. Where anything on this website conflicts with your signed Agreement, your signed Agreement prevails.

01 Who we are and acceptance of these terms

This website (homeandheart.nz and any pages published under it relating to Home & Heart Property Management) is operated by Navigate Japan Limited, a company registered in New Zealand (NZBN 9429052367342), trading as Home & Heart Property Management.

By browsing this website, submitting an enquiry through it, or otherwise using it, you accept these terms. If you do not accept them, please do not use this website.

These terms apply to this website only. They sit alongside, and do not replace, our published Privacy Policy.

02 This website is not an offer of services

Nothing on this website constitutes an offer capable of acceptance, and browsing it, reading it, or submitting an enquiry through it does not create a property management relationship, a tenancy, an agency, or any other contractual relationship between you and us.

A relationship for property management services begins only when you and Navigate Japan Limited have both signed a Property Management Agreement for a specific property. That Agreement — not this website — sets out the services provided, the fees that apply, each party's obligations, and each party's rights on the matters it covers.

Why we're explicit about this

A signed Agreement is negotiated and confirmed with each owner individually, and its terms can differ from what this website describes in general terms — most commonly around fees, timing, and property-specific arrangements. Keeping this website's role limited to general information, and treating the signed Agreement as the governing document, avoids the two ever being read as competing with each other.

03 Information published on this website

We try to keep this website accurate and current, and we correct errors we become aware of. Even so:

  • Content is general information about our services, written for a general audience, and does not take your individual circumstances into account.
  • Content may become out of date between updates — for example where a fee, a legal requirement, or a government proposal changes after a page was last published.
  • Nothing on this website should be relied on as a final statement of what applies to a specific property, tenancy, or owner. Where we can confirm something in writing for your specific situation, we will.

To the extent permitted by law, we do not warrant that this website is complete, error-free, or continuously available.

04 Enquiries and appraisal requests

Where this website invites you to request a free appraisal or make an enquiry, submitting one does not commit you to anything, does not commit us to accepting your property for management, and does not create a binding arrangement of any kind.

We aim to respond to enquiries within two business days, but this is a target, not a guarantee, and response times may vary — particularly around public holidays or unusually high enquiry volumes.

Information you give us in an enquiry (including about a property, a tenancy, or yourself) is used to respond to that enquiry and, if you proceed, to prepare an appraisal or an Agreement. See Privacy below.

05 Fees referred to on this website

Where this website mentions fees, they are published for general guidance so you can understand roughly how the service is priced. They are not, on their own, a quote, a binding fee schedule, or an offer.

  • The fees that actually apply to your property are the ones set out in your signed Property Management Agreement.
  • Fees shown on this website may be revised from time to time, including between the date you read this page and the date you sign an Agreement.
  • Some fees depend on matters specific to a property — for example its rental value, its location, or how it is currently tenanted — and cannot be finalised until we have assessed it.

If you would like current, property-specific pricing, please request an appraisal.

06 If you are a tenant or applicant

This website is written primarily for property owners, but we recognise that tenants and rental applicants use it too — for example to view a listing, complete an application, or find our contact details.

If you are a tenant of a property we manage, your tenancy is governed by your tenancy agreement and the Residential Tenancies Act 1986, not by these website terms. If you are an applicant, submitting an application does not guarantee a tenancy will be offered, and applications are assessed on the criteria we make available to you at the time.

These website terms still apply to your use of the website itself — for example, the sections on intellectual property, acceptable use, and privacy.

07 Other Home & Heart services

Navigate Japan Limited also operates other services under the Home & Heart name, including property clearance and property maintenance services, each with its own terms and conditions published on its own pages.

Engaging Home & Heart Property Management does not obligate you to use any other Home & Heart service, and using another Home & Heart service does not automatically apply that service's terms to your property management arrangement, or vice versa. Where one division carries out work for a client of another — for example maintenance work at a managed property — that arrangement is disclosed and approved separately, as set out in your Property Management Agreement.

08 No professional advice

General information on this website about tenancy law, compliance obligations, tax, or related topics is provided to help you understand the service — it is not legal, tax, financial, or other professional advice, and should not be relied on as such.

Your circumstances, and the law as it applies to them, can be more specific than a general website page can cover. We recommend you seek independent professional advice before making decisions about your property, your tenancy, or your obligations as a landlord.

09 Regulatory and legislative references

This website may refer to New Zealand legislation, government proposals, or regulatory developments that affect residential property management — for example, obligations under the Residential Tenancies Act 1986 and the Healthy Homes Standards, or the light-touch regulatory regime for property managers proposed by the Government in March 2026.

Proposed is not enacted

Where we describe something as proposed, announced, or under development, that means exactly that — it reflects a government announcement or policy direction as at the date it was published on this website, not a change in the law. We describe the status accurately as we understand it at the time of writing, but legislative and regulatory processes can move, stall, or change in ways this website may not yet reflect. Check the relevant government agency directly for the current position before relying on it.

10 Intellectual property

The text, design, layout, images used with permission, and the Home & Heart name and branding on this website belong to, or are licensed to, Navigate Japan Limited. You may view and print pages of this website for your own personal, non-commercial use in considering our services.

You may not reproduce, republish, distribute, or use this website's content for any commercial purpose, or represent it as your own, without our prior written consent.

11 Links to other websites

This website may link to external websites — for example, government agencies such as Tenancy Services, for your convenience. We don't control those websites, and a link is not an endorsement of their content, accuracy, or availability. Use of any external website is at your own discretion and subject to that website's own terms.

12 Privacy

We handle personal information collected through this website in accordance with the Privacy Act 2020 and our published Privacy Policy, which explains what we collect, why, and how you can access or correct it.

13 Acceptable use

You agree not to use this website to:

  • attempt to gain unauthorised access to this website, its systems, or any account or data it holds;
  • introduce malicious code, or interfere with the website's normal operation;
  • submit false, misleading, or fraudulent information through an enquiry or application; or
  • use automated means to extract content from this website at scale, other than standard search-engine indexing.

We may restrict or suspend access to this website, without notice, for anyone we reasonably believe is in breach of this section.

14 Liability

To the maximum extent permitted by law, Navigate Japan Limited is not liable for any loss or damage arising from your use of, or reliance on, this website, including where information on it is later found to be inaccurate or out of date, or where the website is unavailable.

This section concerns your use of the website only. It does not limit or affect the liability provisions in a signed Property Management Agreement, which are agreed separately and apply to the actual provision of services.

Nothing in these terms excludes, limits, or modifies any right or remedy that cannot lawfully be excluded, including under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

15 Your consumer rights

Nothing in these website terms is intended to limit any right you have under New Zealand consumer law. Where you engage us for property management services, your rights in connection with that service are addressed in your signed Property Management Agreement, read together with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply.

16 Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute arising from your use of this website.

17 Changes to these terms

We may update these terms from time to time, including to reflect changes to our services, our website, or the law. The version published on this website is the version in effect, and takes effect from the date shown at the top of this page. We encourage you to check this page occasionally if you use this website regularly.
